Masuri exceptionale in Romania: decretarea starii de urgenta / Exceptional measures in Romania: state of emergency declared

Incepand de luni, 16.03.2020, in Romania a fost decretata stare de urgenta, ce impune masuri exceptionale pentru prevenirea, limitarea si realizarea managementului consecintelor generate de raspandirea Covid-19, chiar prin restrangerea unor drepturi si libertati, dintre care amintim: Starting Monday, 16.03.2020, Romania declared a state of emergency, which imposes exceptional measures for the prevention, mitigation and management of the consequences generated by the Covid-19 outbreak, including by restricting certain rights and freedoms, of which we mention:
(A) Domeniul economic:

  • Guvernul poate adopta masuri de sustinere a operatorilor economici in domeniile afectate de Covid-19 (fara a se preciza in concret care sunt aceste masuri sau domeniile posibil afectate);
  • autoritatile publice centrale pot rechizitiona unitati de productie materiale si echipamente necesare combaterii acestei epidemii;
  • beneficiarii fondurilor europene afectati de adoptarea masurilor de urgenta prevazute in prezentul decret pot decide, impreuna cu autoritatile de management/organismele intermediare, sa suspende contractele de finantare incheiate conform legii;
  • operatorii economici a caror activitate este afectata in contextul COVID-19 pot cere, in baza documentelor justificative, Ministerului Economiei, Energiei si Mediului de Afaceri sa elibereze certificate de situatie de urgenta;
  • documentele a caror valabilitate expira pe perioada starii de urgenta isi mentin valabilitatea;
  • se pot plafona preturile la medicamente si aparatura medicala, la alimentele de stricta necesitate si la serviciile de utilitate publica (energie electrica si termica, gaze, alimentare cu apa, salubritate, carburanti etc.), in limita pretului mediu din ultimele 3 luni inaintea declararii starii de urgenta;
(A) Economic sector:

  • the Government can adopt measures to support the economic operators in the areas affected by COVID-19 (without specifying what these measures are or the areas may be affected);
  • the central public authorities can requisition plant and equipment production units necessary to combat this epidemic;
  • the beneficiaries of European funds affected by the adoption of the emergency measures provided in this decree may decide, together with the managing authorities/intermediary bodies, to suspend the financing contracts concluded according to the law;
  • economic operators whose activity is affected in the context of COVID-19 may request, based on supporting documents, the Ministry of Economy, Energy and Business Environment to issue state of emergency certificates;
  • the documents whose validity expire during the state of emergency shall maintain their validity;
  • prices can be capped on drugs and medical equipment, on strictly necessary foods and on public utility services (electricity and heat, gas, water supply, sanitation, fuels, etc.), within the limit of the average price of the last 3 months before declaring the state of emergency;

(B) Domeniul muncii si protectiei sociale:

  • Guvernul poate sprijini angajatorii si angajatii afectati de efectele crizei, prin derogari de la dispozitiile legale in vigoare;
  • se suspenda efectuarea controalelor la angajatori de catre ITM, cu cateva exceptii prevazute la art. 34 din Decret;
  • se mentine valabilitatea contractelor colective de munca si acordurilor colective;
  • se pot efectua angajari fara concurs in institutiile din cadrul sistemului national de aparare si securitate nationala;
  • institutiile publice si cele private introduc, acolo unde e posibil, pe perioada starii de urgenta, munca la domiciliu sau in regim de telemunca, prin act unilateral al angajatorului;
(B) Employment and social security sector:

  • the Government can support the employers and employees affected by the effects of the crisis, by allowing derogations from the legal provisions in force;
  • suspension of controls of employers made by the Territorial Labor Inspectorate, with some exceptions provided in art. 34 of the Decree;
  • the validity of collective bargaining agreements and collective employment agreements;
  • institutions within the national defense and security system can hire personnel without competitions;
  • public and private institutions shall instate, where possible, during the state of emergency, working from home or in teleworking, by unilateral act of the employer;

(C) Domeniul justitiei:

  • activitatea de judecata continua doar in cauzele de urgenta deosebita, in timp ce judecarea celorlalte procese civile si penale se suspenda de plin drept pe durata starii de urgenta;
  • activitatea de executare silita continua numai in cazurile in care este posibila respectarea regulilor de disciplina sanitara stabilite prin hotararile Comitetului National privind Situatiile Speciale de Urgenta, in scopul ocrotirii drepturilor la viata si la integritate fizica ale participantilor la executarea silita;
  • prescriptiile si termenele de decadere de orice fel nu incep sa curga, iar, daca au inceput sa curga, se suspenda pe toata durata starii de urgenta;
(C) Legal sector

  • the trials continue only in cases of special urgency, while the judgment of the other civil and criminal cases is fully suspended during the state of emergency;
  • the mandatory enforcement activity continues only in cases where it is possible to comply with the health discipline rules established by the decisions of the National Committee on Special Emergency Situations, in order to protect the rights to life and physical integrity of the participants in the mandatory enforcement;
  • the statute of limitations and deadlines of any kind do not start to flow and, if already ongoing, they will be suspended during the entire state of emergency;
(D) Pe durata starii de urgenta, cursurile din toate unitatile si institutiile de invatamant se suspenda; (D) During the state of emergency, courses of all national education units and institutions are suspended;
(E) Comunicarea documentelor catre institutiile publice: Autoritatile administratiei publice centrale si locale, ONRC si oficiile registrului comertului de pe langa tribunale, instantele judecatoresti vor folosi preponderent mijloacele electronice de comunicare; (E) Communication of documents to public institutions: Central and local public administration authorities, National Trade Registry Office and trade registry offices with courts, and the courts will use mainly electronic means of communication;

Starea de urgenta permite aplicarea si altor masuri de prima urgenta in mod gradual in functie de evolutia situatiei epidemiologice, cum ar fi:

  • izolarea si carantinarea persoanelor inclusiv a unor cladiri, localitati sau zone geografice;
  • inchiderea graduala a punctelor de trecere a frontierei de stat si interzicerea graduala a circulatiei rutiere, feroviare, maritime, fluviale sau aeriene pe diferite rute si a metroului;
  • inchiderea temporara a unor restaurante, hoteluri, cafenele, cluburi, cazinouri, sedii ale asociatiilor si ale altor localuri publice;
  • identificarea si rechizitionarea de stocuri, capacitati de productie si distributie, de echipamente de protectie, dezinfectanti si medicamente utilizate/utilizabile in tratarea COVID-19;
  • limitarea activitatii spitalelor publice la internarea si rezolvarea cazurilor urgente.
The state of emergency allows the application of other emergency measures, gradually, depending on the evolution of the epidemiological situation, such as:

  • isolation and quarantine of persons, buildings, cities or geographical regions;
  • the gradual closure of border crossings and the gradual prohibition of road, rail, maritime, river or air traffic on different routes and of the subway;
  • temporary closure of restaurants, hotels, cafes, clubs, casinos, headquarters of associations and other public places;
  • identification and requisitioning of stocks, production and distribution capacities, protective equipment, disinfectants and drugs used/usable in the treatment of COVID-19;
  • limiting the activity of public hospitals to the hospitalization and treatment of urgent cases.
Starea de urgenta a fost declarata pentru 30 de zile, perioada in care gestionarea masurilor revine ministrului afacerilor interne si Comitetul National pentru Situatii Special de Urgenta. The state of emergency was declared for 30 days, period in which the management of the measures is under the responsibility of the Minister of Internal Affairs and the National Committee for Special Emergency Situations.

Presedintele Romaniei, cu incuviintarea Parlamentului, poate prelungi durata starii instituite si poate extinde ori restrange aria sa de aplicare, in functie de evolutia situatiilor de pericol. Incetarea aplicarii masurii exceptionale se dispune tot prin decret, cu incuviintarea prealabila a Parlamentului. The President of Romania, with the approval of the Parliament, can extend the duration of the state of emergency and can expand or narrow its scope, depending on the evolution of the dangerous situations. The cessation of the application of the exceptional measure is also ordered by decree, with the prior consent of the Parliament.
Pe durata starii de urgenta, autoritatile si institutiile publice, agentii economici si populatia sunt obligate sa respecte si sa aplice prevederile legale speciale si masurile dispuse de autoritatile competente, sub sanctiunea raspunderii disciplinare, civile, contraventionale ori penale, dupa caz.
During the state of emergency, public authorities and institutions, economic agents and the population must observe and apply the special legal provisions and the measures ordered by the competent authorities, under the sanction of disciplinary, civil, administrative or criminal liability, as the case may be.
In cazul raspunderii contraventionale, amenzile sunt de la 100-5.000 Lei, pentru persoanele fizice, si de la 1.000-70.000 Lei, pentru persoanele juridice.
In the case of the administrative liability, the fines range from RON 100-5,000 for individuals, and from RON 1,000 – 70,000 for legal entities.
